Investigators obtained enough evidence to support forensic analysis of items associated with the old medication bottle and circumstances around the drink preparation.
No test could travel backward through time and tell us precisely what happened at every family gathering.
Robert’s hospital blood sample did not establish a dramatic overdose.
That mattered.
His symptoms were consistent with excessive blood-pressure medication, but not uniquely diagnostic of it.
The prosecution therefore did not build its entire case on toxicology.
Instead, the medication evidence supported the broader pattern.
Then Derek made a mistake.
He contacted Robert.
Despite being told through counsel not to discuss the case informally.
He texted:
Tell them you mixed up your pills.
Robert did not respond.
Derek sent:
You know this is getting out of control.
Then:
I never meant to actually hurt you.
That final message mattered enormously.
Still not a complete confession.
What did “actually hurt” mean?
His attorney later argued Derek meant the financial dispute.
Investigators preserved the messages.
Then Derek called Veronica.
She recorded the call after receiving legal guidance regarding applicable consent rules.
He told her:
“Your father was supposed to get tired, not end up in a hospital.”
