Chapter 10 - THE TRUST HEARING

The court eventually addressed the Miller Road property.
The bank could not simply take more than Robert legally possessed.
The trust terms mattered.
So did the lender’s due diligence.
So did fraudulent representations.
After extensive proceedings, the purported lien against the underlying remainder interest was not enforced as the bank originally expected.
Robert remained liable for valid business obligations.
My forged guaranty was treated separately.
The trust also sought remedies for violations involving taxes, insurance, and attempted encumbrance.
I had options.
Push aggressively to terminate my parents’ occupancy.
Or negotiate.
Everyone expected revenge.
I chose structure.
Robert and Helen could remain temporarily under a court-approved agreement while alternative housing was arranged.
Certain property expenses were brought current from lawful trust resources and settlement allocations where permitted.
They surrendered disputed management authority.
Future borrowing against the property was prohibited.
An independent trustee assumed administration.
Eventually, Robert and Helen moved to a smaller townhouse.
Not poverty.
Not homelessness.
