Chapter 5 - WHY WALTER CHOSE ME
The deed attorney was still alive.
Thomas Greene.
Seventy-four.
Semi-retired.
Sharp.
He remembered Walter.
When Patricia asked why Walter transferred the house to me rather than Ryan, Thomas paused.
“Because Walter was afraid Ryan would never stand up to Linda.”
Ryan sat beside me.
He went completely still.
Thomas continued.
“Walter loved his wife. He also knew she controlled the children financially.”
He explained.
The house had originally been Walter’s separate property, inherited from his parents.
He wanted Ryan’s family to remain there after his death.
But if he left it to Ryan, he feared Linda would pressure Ryan into refinancing, selling, or using it to support Rachel and Ethan.
“So he gave it to me?”
“Yes.”
“I barely knew him.”
“He knew enough.”
Thomas pulled out a letter Walter dictated for the file.
Not a secret will.
Not legally operative beyond the executed documents.
A statement of intent.
It read:
Emily does not ask for things.
That is exactly why Linda will always assume Emily has no claim to anything.
I want the residence protected from that dynamic.
Ryan closed his eyes.
Thomas continued reading:
If Ryan and Emily remain married, the home provides stability.
If they do not, Emily should not be left housing-insecure because my family taught her she only belonged through Ryan.
I cried.
Quietly.
Not because Walter had rescued me.
Because he had seen the thing everyone else normalized.
The trust was supposed to prevent the house from becoming financially burdensome.
Linda as trustee was Walter’s compromise.
He believed she would respect formal fiduciary duties even if she resented the beneficiary.
He had been wrong.
Or at least, the evidence increasingly suggested he had been.
Walter’s medical records showed no cognitive impairment when he signed the deed and trust.
His physician documented normal decision-making capacity.
Two witnesses confirmed execution.
Linda’s potential challenge to the deed weakened substantially.
She eventually stopped threatening to invalidate it.
