Chapter 11 - The Fight for Emergency Custody
Maris was arrested that afternoon.
But arrest did not automatically make Gideon Lumi’s legal parent.
He was her stepfather.
Nothing more on paper.
Child services had to determine where Lumi would stay.
Maris’s attorney argued she should be placed with a maternal aunt in Nevada.
Lumi had met the woman twice.
She cried when she heard the name.
“She tells Mom everything.”
Gideon requested emergency guardianship.
The hearing happened the next morning.
He wore the same pale-blue scrubs because he had not gone home.
Lumi sat beside Dana in the courtroom.
Maris appeared by video from jail.
Her attorney questioned Gideon’s motives.
“You have been married to Ms. Hale for less than two years.”
“Yes.”
“You are not the child’s biological father.”
“No.”
“You concealed recordings rather than immediately reporting them.”
“I secured the evidence and contacted a child-advocacy social worker.”
“You discussed adoption with Maris before this incident, correct?”
“Yes.”
“So you wanted Lumi for yourself.”
Gideon’s jaw tightened.
“I wanted her safe.”
The attorney turned toward Lumi.
“Did Gideon ever tell you to record your mother?”
Lumi shook her head.
“Who told you?”
“My dad.”
The courtroom became silent.
She explained that Owen’s old phone had played a recorded instruction when she turned it on.
“If Mommy scares you, press the red circle. Hide the card with Rabbit.”
Owen had created a safety plan for a four-year-old child.
Lumi had remembered it for three years.
She began recording only after Maris threatened to “make another fire.”
The judge asked Lumi where she wanted to stay.
She looked at Gideon.
“With the person who believed me before I could tell.”
The judge granted Gideon temporary guardianship.
Maris’s aunt was denied contact pending investigation.
Outside the courtroom, Lumi took Gideon’s hand.
“Are you still my family?”
He crouched in front of her.
“I was your family before a judge said it.”
She leaned into him.
For the first time, she did not cry because they were alone.
