Chapter 10 - The Petition for Custody

Evelyn filed an emergency petition for custody.

Her attorney claimed Abigail was an absent mother who worked long hours and left Hunter with relatives.

The petition described Evelyn as the child’s primary caregiver.

It claimed Hunter’s injuries occurred because Abigail failed to provide stability.

Bertha submitted a supporting statement.

She wrote that Abigail was emotionally volatile.

That she neglected medical appointments.

That she used Evelyn for free childcare and then blamed her when Hunter was hurt.

Abigail read the documents in disbelief.

“They’re saying I did this.”

Her attorney nodded.

“They are trying to create doubt before the evidence is formally presented.”

Evelyn also included photographs.

Abigail sleeping on the couch after overnight shifts.

Unwashed dishes.

A late rent notice from two years earlier.

Each image was real.

None proved abuse.

Together, they were designed to create a story.

Abigail began to panic.

“What if the judge believes her?”

Detective Cole placed the black smartphone on the table.

“The ICU recording captured Hunter identifying them.”

Her attorney added the medical reports.

The bank records.

The urgent care note.

The shed latch evidence.

The security footage.

The toy recordings.

One photograph of a tired mother could not erase a pattern of deliberate cruelty.

Still, Abigail knew the fight would be brutal.

Evelyn had spent years presenting herself as the dependable grandmother who rescued her struggling daughter.

Friends believed her.

Church members trusted her.

Neighbors called her generous.

When the custody petition became known, several people defended Evelyn publicly.

They said Abigail must be confused.

That Evelyn loved Hunter.

That Bertha would never harm a child.

Hunter heard one of the comments during a hallway conversation.

He looked at Abigail.

“Do they think I lied?”

She knelt beside him.

“No.”

“Some do.”

Abigail did not insult him with false reassurance.

“Yes.”

His eyes filled.

“What if Grandma says I’m bad?”

“Then I will tell the truth louder.”

Hunter shook his head.

“Don’t yell.”

Abigail took his hand.
