Chapter 13 - The Judge’s Decision
Judge Avery addressed both legal teams.
“My connection to Captain Whitmore is profound but historical.”
He acknowledged that Claire had saved his life.
He also acknowledged that his reaction in court could create an appearance of bias.
“For that reason, I will transfer the final custody ruling to Judge Elaine Porter.”
Gavin’s replacement attorney smiled faintly.
Then Avery continued.
“However, all evidentiary findings, preservation orders, and contempt matters entered before transfer remain in force.”
Gavin’s smile disappeared again.
Avery would not decide custody.
But he had ensured the evidence could not vanish.
Before leaving the bench, he looked toward Claire.
“The court thanks you for your candor.”
Claire saluted him once.
Not theatrically.
Not for the spectators.
A quiet acknowledgment between two survivors.
Lily watched.
Outside the courtroom, she asked, “Are you sad he’s leaving?”
“No.”
“Did he believe you?”
“Yes.”
“Then why can’t he stay?”
“Because justice must not only be fair. It must look fair.”
Lily considered that.
“Dad always said fairness meant he got another chance.”
Claire looked toward Gavin speaking with his new attorney.
“Fairness does not mean escaping consequences.”
Judge Porter scheduled the next hearing for three weeks later.
During that time, Gavin received supervised contact only.
He was prohibited from discussing the case with Lily.
At the first supervised visit, he ignored the order.
He told Lily Judge Avery had been Claire’s secret friend.
He claimed the military arranged the recordings.
The supervisor ended the visit after six minutes.
Gavin blamed Claire.
Lily did not.
She wrote in her journal:
Dad says everyone is controlled by Mom. But Mom is the only one who does not tell me what to say.
Rachel read the entry with Lily’s permission.
