Chapter 2 - The Accusation Against the Judge

“You know her personally!”
Gavin struggled against the deputies.
“This judge cannot hear this case!”
Judge Avery’s expression returned to controlled formality.
“Mr. Whitmore, sit down.”
“You just called her Captain. You stepped off the bench for her.”
Claire remained beside Lily.
She had not expected Avery to recognize her.
Not after sixteen years.
Not after an operation the Army had sealed behind layers of classified reports and official silence.
Gavin’s attorney stood.
“Your Honor, we request immediate recusal.”
Judge Avery looked toward Claire.
“Captain Whitmore, have we had any personal contact since the incident you referenced?”
“No, Your Honor.”
“Have we communicated regarding this custody matter?”
“No.”
“Did you know I would be assigned today?”
“No.”
Avery faced the courtroom.
“My recognition of Captain Whitmore comes from an event that occurred before I became a judge. I will disclose the relevant facts on the record.”
Gavin laughed bitterly.
“Relevant facts? She has been using military connections from the beginning.”
Lily’s fingers tightened around Claire’s hand.
Claire felt her daughter trembling.
The guardian placed the sealed phone on the evidence table.
Gavin kept looking at it.
Not at the judge.
Not at Claire.
At the phone.
Claire noticed.
So did the guardian.
Judge Avery returned to the bench.
“Until questions concerning impartiality are resolved, the phone will remain sealed.”
Gavin exhaled with visible relief.
Claire understood immediately.
He was not trying to remove the judge because of fairness.
He was buying time.
Judge Avery looked toward the deputies.
“Mr. Whitmore will remain seated and will not approach the child or the evidence.”
Then Lily leaned toward Claire.
“Mom, he knows the password.”
Claire turned.
“What password?”
