Chapter 15 - The Trial of Dr. Preston Pierce
Preston’s defense portrayed him as a deceived husband.
Khloe was obsessive.
Manipulative.
Dangerous.
The defense argued that Preston’s only crime was trusting the wrong person.
Elena listened from the prosecution table.
Trust was not the issue.
Authority was.
Preston had used his position as physician and husband to override her.
Miriam testified first.
She described the order to stop the epidural.
The hidden recording.
The altered consent form.
The mismatched syringe.
“Why did you refuse his order?” the prosecutor asked.
“Because it was unsafe.”
“Was Dr. Pierce aware of the patient’s pelvic history?”
“Yes.”
“Was he aware she requested surgery?”
“Yes.”
“Did he document that request?”
“No.”
Maria Ellis testified next.
She described warning Preston about Khloe’s syringe.
He dismissed her as confused.
Then Khloe testified.
She admitted everything.
Preston stared at her with hatred.
Khloe said, “He didn’t tell me to hurt Elena.”
The defense smiled.
Then she continued.
“He taught me she would never be believed.”
The smile disappeared.
Elena took the stand last.
Preston’s attorney asked whether marital conflict influenced her perception.
Elena remained calm.
“I was in active labor. The monitor showed fetal distress. My prior pelvic injury was documented. I requested a cesarean. Those are facts.”
“You were angry with your husband.”
“Yes.”
“Jealous of Ms. Mercer.”
“No.”
“Did you strike a tray from her hand months earlier?”
“Yes.”
“Would you describe that as aggressive?”
“I would describe allowing the wrong drug to reach a patient as more aggressive.”
The courtroom became quiet.
The attorney changed direction.
“Dr. Pierce did not know the syringe contained oxytocin.”
“I believe that.”
The defense looked relieved.
Elena continued.
“He knew my chart was false. He knew I had not consented. He knew pain was being used to force compliance. He did not need to know every detail of her plan to become responsible for creating the conditions that allowed it.”
Preston finally looked down.
The jury deliberated for ten hours.
He was convicted on every major count except attempted murder.
